National Law was published in the National Printing Office. 4495/2017 entitled “Control and protection of the built environment and other provisions.”
Under Article 94 of this law, arbitrary constructions made after July 28, 2011 are demolished compulsory and fines for the construction and maintenance of arbitrary are imposed, and also criminal sanctions, in accordance with the provisions of this article, subject to the distinction in Article 81 (urban planning offenses).
Penalties for the construction and maintenance of arbitrary houses and penalties for arbitrary constructions made prior to that date are imposed, but not for any reason whatsoever, are subject to the provisions of the present Sanctions for imposing sanctions.
The minimum amount of the fine is two hundred and fifty (250) euros. The minimum amount of the retention penalty is one hundred (100) euros.
According to article 102 for arbitrary constructions subject to the provisions for the suspension of sanctions of Article 97, an application for membership with its supporting documents may be submitted to the information system until 8/11/2019. By joint decision of the Ministers of Finance and Environment and Energy, the above deadline for membership may be extended.
The single special fine shall be calculated in accordance with Annex A and shall be reduced where specifically specified in the provisions hereof. The fine shall be reduced in the following cases:
a) 20 percent (20%) if the arbitrary construction or use is subject to the provisions hereof until 8.4.2018,
b) Ten percent (10%) if the arbitrary construction or use is subject to the provisions of this present from 9.4.2018 to 8.10.2018,
c) ten percent (10%) if the applicant submits the static proficiency study at the same time as the declaration of affiliation.
The single special fine shall be increased:
a) Ten per cent (10%) if the arbitrary construction or use is subject to the provisions of this Agreement from 9.10.2018 to 8.2.2019,
b) 20 per cent (20 %) if the arbitrary manufacture or use is subject to the provisions hereof after 9.2.2019,
c) Ten per cent (10%) if the arbitrary construction or use is in protected areas for which presidential decrees have been issued.
Article 103 states that people with Disabilities (disabled) with a disability percentage of 80% or more, as well as people who are taxed by people with the above qualities, with individual income up to forty thousand (40,000) euro or family income up to sixty thousand (60,000 ), for the purposes of Article 97, they pay 15% of the single special fine, irrespective of the main residence limit, and submit the supporting documents proving the above-mentioned conditions. The invalidity rate is certified by an attestation or report issued by the Disability Certification Center.
